Acceptable Use Policy

Customers may not use the Company’s services for any purpose that is unlawful or prohibited by this AUP. Prohibited activities include, without limitation, the transmission, storage, distribution, or hosting of any material that:

• Violates any applicable local, provincial, federal, or international law, regulation, or treaty.
• Infringes upon the intellectual property rights of others, including copyrights, trademarks, patents, or trade secrets.
• Is defamatory, harassing, threatening, or invasive of another’s privacy.
• Constitutes or facilitates fraud, phishing, identity theft, or the sale of stolen goods or data.
• Contains or promotes child sexual abuse material (CSAM), which the Company reports to the appropriate authorities without exception.

The following content and services may not be hosted on, or distributed through, the Company’s network. This list is illustrative and not exhaustive:

• Malware, viruses, worms, trojans, ransomware, rootkits, or any code designed to disrupt, damage, or gain unauthorized access to systems.
• Hacking tools, exploit kits, or resources intended primarily to facilitate unauthorized access to third-party systems.
• Phishing pages, fraudulent websites, or content designed to deceptively collect credentials or personal information.
• Unlicensed or pirated software, media, or other copyrighted works distributed without authorization.
• Content that promotes violence, terrorism, or discrimination against individuals or groups.

Customers are prohibited from engaging in any activity that disrupts or interferes with the Company’s network, other customers, or third-party networks. Prohibited network activity includes, without limitation:

• Launching, participating in, or serving as the target of Denial of Service (DoS) or Distributed Denial of Service (DDoS) attacks.
• Unauthorized port scanning, vulnerability probing, or penetration testing of systems the Customer does not own or lack written authorization to test.
• Packet flooding, mail bombing, or any deliberate attempt to overload a host, service, or network.
• Forging TCP/IP packet headers, e-mail headers, or any part of a message’s routing information.
• Operating open proxies, open relays, or open recursive DNS resolvers that facilitate abuse.

Customers are prohibited from violating, or attempting to violate, the security of the Company’s network or any other network. Violations may result in civil or criminal liability. Prohibited activities include accessing data or accounts not intended for the Customer, attempting to breach authentication or security measures without authorization, and taking any action to obtain services to which the Customer is not entitled. The Company will investigate suspected violations and may cooperate with law enforcement in the prosecution of offenders.

The Company maintains a zero-tolerance policy toward the sending of Unsolicited Commercial Email (UCE) or SPAM. Customers may not use, or permit others to use, the network to transmit UCE, nor host or permit the hosting of sites or information advertised by UCE originating from other networks. Prohibited practices also include maintaining or importing purchased, harvested, or non-consensual mailing lists, and operating in a manner that causes the Company’s IP space to be listed on any recognized abuse or spam blocklist. Violations may result in immediate suspension and are subject to the penalties described in the Terms of Service.

While the Company offers unmetered bandwidth on eligible plans, Customers may not use resources in a manner that degrades service for others or that is inconsistent with the intended use of the product. Prohibited resource usage includes sustained abuse of shared network capacity, cryptocurrency mining on plans not designated for that purpose, and any activity that the Company’s administrators reasonably determine to be abusive or disruptive to neighboring customers.

The Company respects the intellectual property rights of others and expects its Customers to do the same. The Company will respond to clear notices of alleged copyright infringement that comply with applicable law. Upon receipt of a valid notice, the Company may remove or disable access to the allegedly infringing material and may suspend or terminate the accounts of Customers who are repeat infringers. Notices should be submitted through the Company’s abuse contact.

Suspected violations of this AUP may be reported to the Company’s abuse team through the contact channels published on the Company’s website. Reports should include sufficient detail — such as relevant IP addresses, timestamps, log excerpts, and message headers — to enable the Company to investigate. The Company treats all abuse reports seriously and initiates an investigation, typically within 48 hours of notification.

Violation of this AUP may result, at the Company’s sole discretion, in the restriction, suspension, or termination of the Customer’s services, with or without prior notice. The Company will typically suspend only the specific service in breach, but may suspend all Customer services where warranted. Customers found to be in violation shall not be entitled to a refund of any fees paid in advance prior to such action, and the Company reserves the right to pursue civil remedies and to notify law enforcement where a violation is believed to constitute a criminal offense. The Service Level Agreement, refund guarantees, and all other guarantees are void where any provision of this AUP or the Terms of Service is violated.

This Acceptable Use Policy shall be governed by and construed in accordance with the laws of the Province of Ontario, consistent with the Company’s Terms of Service. This AUP supplements, and does not replace, the Terms of Service; in the event of a conflict, the Terms of Service shall control except with respect to matters expressly addressed herein.
